Camping Bijou du Doubs – General Terms and Conditions - Definitions - Rental property: object of rental: mobile home, wooden chalet, pitch (for tent, caravan, motor home, etc.) - Accommodation: mobile home, wooden chalet - Party: the tenant/client/camper on the one hand and Bijou du Doubs SAS on the other hand, together referred to as the parties. Application - These general terms and conditions (GTC) govern the reservation, rental and provision of a rental property and come into force as soon as the order is placed. The placing of the order with Bijou du Doubs SAS and the conclusion of the contract between the parties takes place when the client pays the deposit. By doing so, the client accepts these GTC without reservation. The signing of a written contract by the parties is not necessary. Reservation procedure - 1) The client requests a rental property in person, by telephone or by e-mail from Bijou du Doubs SAS. 2) Bijou du Doubs SAS sends the client a booking option by e-mail indicating the total price, the amount of the down payment required and the rental period requested by the client. 3) The client pays the amount of the down payment by bank transfer only to the account mentioned in the e-mail and thus automatically accepts these GTC. 4) After receipt of the down payment, Bijou du Doubs SAS will send an e-mail to the client confirming receipt of the payment and the reservation. Booking conditions - If the down payment is not received by the date indicated in the booking option e-mail, Bijou du Doubs SAS reserves the right to offer the rental property requested by the client to another client. The reservation of a rental property is strictly personal. A reservation may not be sublet or transferred without the prior agreement of Bijou du Doubs SAS. Terms of payment - The down payment must be paid before the date indicated in the booking option e-mail. The balance is due on arrival at the campsite and must be paid at the latest on departure. Only in case of prior agreement between the parties, the balance can be paid by bank transfer after the departure of the tenant. Rates - The rates for rental properties are available on the website of Bijou du Doubs SAS and serve as the basis for the conclusion of the contract between the parties. The extent of services provided by Bijou du Doubs SAS for a rental property is determined by the rates and descriptions on the website. The rates include the applicable tourist tax and must be paid by the tenant. The booking of a rental property incorporetes a reservation fee for the tenant. The amount of this fee is stipulated in the rates in force at the time of the booking request by the tenant. These fees must be paid with the down payment. Deposit - For the accommodation, the tenant must pay a deposit in cash on arrival, the amount of which is indicated in the rates. This will be returned to the tenant at departure, after a satisfactory review of the accommodation. Otherwise, the following amounts will be deducted from the deposit: • The value of any missing or damaged items. • In case the accommodation has not been sufficiently cleaned, an amount of 50 € (in addition to the cleaning costs stated in the rates). • The amount of repairs in case of damage caused by the tenant. The partial or full withholding of the deposit does not exclude additional compensation for Bijou du Doubs SAS if the repairs to the damage exceed the amount of the deposit. Access to the campsite during the Corona period - The client undertakes to respect any measures imposed by the competent authorities for access to the campsite or its facilities. This includes, where applicable, the unsolicited presentation of the relevant medical certificates on arrival at the campsite. Provision and use of the accommodation - Arrival - We will welcome you in your rental property on the day of your arrival from 4 p.m. until the respective opening time of the reception. Earlier or later arrival is possible by arrangement, but cannot be guaranteed. For accommodation, an inventory of fixtures must be carried out by the tenant, in case of missing inventory or damage, Bijou du Doubs SAS must be informed by 8pm at the latest. In the event of late arrival, the tenant must inform Bijou du Doubs SAS in advance. In the absence of a message from the tenant mentioning his/her lateness, the rental property may be re-let 24 hours after the arrival date indicated in the booking confirmation. The booking fee and the deposit are non-refundable, unless the parties agree otherwise. The client must be insured for civil liability. A certificate of insurance can be requested from the tenant before the start of the stay. Stay - It is the responsibility of the client assure himself: The client is responsible for the surveillance of his/her personal belongings (e.g. bicycle, boat, fishing equipment,). Bijou du Doubs SAS declines all responsibility in the event of theft, fire, bad weather, etc. and in the event of an incident for which the client is liable. The client is obliged to take care of the rental property and all the common facilities on the site and to report any damage immediately. Furthermore, the client is obliged to behave in a respectful manner towards the other guests of the campsite. Daily visitors of the tenant are welcome. However, we ask them to register at the reception desk before entering the campsite. Please note that access to the swimming pool by visitors is only possible against the respective payment. Dogs are welcome, but must always be kept on a leash outside the accommodation. Departure - On the day of departure, the rental property must be vacated before 10.00 am. A later departure is possible after consultation and, if necessary, against payment, but cannot be guaranteed. Changes to the reservation - Before the payment of the down payment, the tenant can change the booking request at any time. No reduction will be granted for late arrival, early departure or reduction in the number of persons (for all or part of the planned stay), unless the parties agree otherwise. Before the start of the booked stay, the client may request a modification to the reservation by electronic means or in person. Bijou du Doubs SAS will respond to this request according to availability and its possibilities, without additional charges, and will contact the client if necessary. In the absence of an agreement between the parties on the modification, the client is in principle obliged to pay the total initial price, unless the parties agree otherwise. The client may, at any time during his stay, request an extension of the duration of his stay. Bijou du Doubs SAS will respond to this request according to availability and possibilities, at the rates in force. The client may, at any time during his stay, request a reduction in the duration of his stay. Bijou du Doubs SAS will accede to this request, but reserves the right to ask for the initial total price. In the event of cancellation of a reservation before the start of the stay, the amount of the down payment shall be retained by Bijou du Doubs SAS, regardless of the date of cancellation, unless the parties agree otherwise. In the event of cancellation of a reservation by Bijou du Doubs SAS, except in cases of force majeure, the down payment already paid will be fully refunded. The client shall provide bank details for this purpose. Internal regulations - The tenant must comply with the campsite's internal regulations, which are available at the reception. In the event of non-compliance with these rules, the person(s) concerned may be expelled without compensation or reimbursement of the down payment and booking fee. Bijou du Doubs SAS non-liability clause - The client expressly recognises that Bijou du Doubs SAS cannot be held responsible for errors in communication with its clients or third parties, or for accidentally erroneous information on the site concerning the campsite and the rentalproperties. This is particularly the case for photos and descriptions of activities, leisure activities, services and opening times. All photos and texts on the Bijou du Doubs SAS website are non-contractual and are given for information purposes only. Non-existence of the right of withdrawal - We inform our clients that, in accordance with article L.221-28 of the French Consumer Code, the sale of accommodation services provided on a specific date or according to a specific frequency is not subject to the provisions relating to the 14-day withdrawal period. Disputes - Applicable law - Any complaint concerning the non-conformity of the services with the contractual obligations can be sent by e-mail or by post to the Bijou du Doubs SAS addresses mentioned on the website. The present general terms and conditions and the contracts concluded by virtue of them are subject to French law. In the event of a dispute, the court of Chalon-sur-Saône shall have sole jurisdiction.
