Services: seasonal accommodation - Accommodation: light leisure accommodation. Article 1 - scope - These General Terms of Sale apply, without restriction or reservation, to any rental of accommodation on the PRL Les Chalets de Fiolles, operated by SAS Les Chalets de Fiolles ("the Provider"), to non-professional customers ("Customers" or "Customer"), on its website http://www.chalets-de-fiolles.com or by phone, mail or e-mail (e-mail), or in a place where the Service Provider. They do not apply to location rentals for mobile homes that are the subject of a "leisure" contract. Prices are expressed in Euros, HT and TTC. These rates are firm and not reviewable during their validity period, as indicated on the http://www.chalets-de-fiolles.com website, in the email or in the written proposal addressed to the Customer. Beyond this period of validity, the offer is out of date and the Provider is no longer bound by prices. The payment requested from the Customer is the total amount of the purchase, including these fees. Article 4 - terms of payment - 4.1. down payment - Advance payments are instalments. They are a value of the total price owed by the Customer. A down payment of 30% of the total cost of the supply of the Ordered Services is required when the customer places the order. This deposit will be 100% if the booking is made less than 30 days before the customer's arrival date. It must be settled as soon as the final rental agreement is received and attached to the copy to be returned. It will be deducted from the total amount of the order. It will not be reimbursed by the Provider in case of cancellation of the stay due to the Customer less than 60 days before the expected arrival date (except in cases provided by Article 6.4 of these terms and conditions). The balance of the stay must be paid in full 30 days before the arrival date (under penalty of cancellation of this rental) - 4.2. Payments - Payments made by the Customer will only be considered final after the claimant's payments are effectively collected. The delay in payment will result in the immediate payment of all the sums owed by the Customer, without prejudice to any other action that the Provider would be entitled to bring against the Customer. 4.3. Non-compliance with payment terms - In addition, the Claimant reserves the right, in the event of non-compliance with the above payment terms, to suspend or cancel the provision of Services ordered by the Customer and/or to suspend the performance of its obligations after notice remained ineffective. Article 5 - provision of services - 5.1. provision and use of services - Accommodation can be occupied from 5pm on the day of arrival and must be vacated by 10am on the day of departure. The balance of the stay must be paid in full 30 days before the arrival date (under penalty of cancellation of this rental) - Accommodation is provided for a specified number of occupants for rent and cannot be occupied by a higher number of people. Accommodation will be returned to the same state of cleanliness as on delivery; Otherwise, the tenant will have to pay a lump sum of 90 € for the cleaning; unless the "household package" and/or "kitchen package" option has/have been chosen (s). Any deterioration of the accommodation or its accessories will result in immediate refurbishment at the tenant's expense. The end-of-rental inventory status must be strictly identical to that of the start of the rental. 5.2. Security deposit - For accommodation rentals, a security deposit of 390 € (300 € for the rental and 90 € for cleaning) is required of the Customer on the day of the handing over of the keys. This deposit is either: - Hand-returned on the day of departure with deducting any rehabilitation costs - In the event that the status of the premises is not made in the presence of the Client at the time of his departure (departure very early, in July-August, health restriction…) this will be carried out as soon as possible and the deposit will then be deleted in the case of a CB fingerprint or destroyed in the case of a deposit by cheque, with possible deduction of reclamation costs and in this case, the Customer will be notified by telephone the same day by the Provider. This bond does not constitute a limit of liability. Article 6 - delay, interruption or cancellation of stay by the customer - No discount will be granted in the case of a delayed arrival, an early departure or a change in the number of people (whether for all or part of the planned stay). 6.1. Amendment - In the event of a change in the dates or number of persons, the Provider will endeavour to accept as much as possible requests for a date change within the availability limit, without prejudice to any additional costs; In all cases, this is a simple obligation of means, since the Provider cannot guarantee the availability of accommodation, or another date; an additional price may be requested in these cases. Any request to reduce the length of stay will be considered by the Provider as a partial cancellation, the consequences of which are governed by Article 6.3.6.2. Interruption - A premature departure will not result in any refund from the Provider. 6.3. Cancellation - In the event of cancellation of the Reservation by the Customer after its acceptance by the Provider less than 60 days before the expected reserved rental date, for any reason except the force majeure, the deposit paid to the Reservation, as defined in Article 4 - terms of payment of these General Terms of Sale will be acquired by the Provider of full right, as compensation, and will not be able to give rise to any refund. In all cases of cancellation, a processing and management fee of 30 € (Article 3) will remain acquired from the Provider. 6.4. cancellation in case of pandemie - 6.4.1. In the event of a total or partial closure of the establishment during the dates of the reserved stay (to which is equated with a total or partial prohibition measure of public reception, to the extent that the Customer is directly affected by the application of this measure) decided by the public authorities, and which is not attributable to the Provider, the sums paid in advance by the Customer for the booking of the stay will be subject to a refund within 30 days. The Provider cannot, however, be required to make additional compensation beyond this reimbursement of the sums already paid for the booking of the stay. 6.4.2. Article 7 - Customer Obligations - 7.1. Civil liability insurance - The Customer housed in a rental must be insured in civil liability. A certificate of insurance may be requested from the Client before the start of the benefit. 7.2. Visitors - Anyone not on the rental agreement will be considered a visitor. Visitors are allowed only between 10am and 11pm (unless they stay asleep) and are the responsibility of the Customers who receive them. No vehicle other than the Customer's vehicle shall enter the PRL compound. Visitors will be required to park in the parking lot at the entrance to the PRL, walk to the reception reception and present identification. The number of visitors will not exceed the total capacity of the rental. The right of access to visitors is paid: 5 € per visitor per day - 10 € per visitor if access to the pool (no access to the pool between mid-July and mid-August and when the PRL is full) - 20 € per night if the visitor stays to sleep, the capacity of the rental can not be exceeded. Under certain conditions, such as a health crisis, the Provider may be forced not to accept visitors. 7.3. Pets - Pets are accepted except in certain rentals (except category 1 and 2 dogs) for packages available from the Provider and on presentation of the vaccination book. They must be under the responsibility of their masters, be tattooed or punched, non-aggressive and necessarily kept on a leash. The stains must be removed by their masters. They must not interfere with the tranquillity of other tenants. Under no circumstances should they be left alone in accommodation or tied to a tree. They must not get on beds and sofas. The Provider has put in place an "animal regulation" that the Customer will have to sign before entering the rental. The billing for possible damage will be added to the price of the stay as well as a cleaning package if you do not leave the accommodation in a state of perfect cleanliness. The household package does not include dirt made by animals. 7.4. Internal Regulation - An internal regulation is posted at the entrance of the establishment and at the reception. The Customer is obliged to take notice of it and respect it. Article 8 - obligations of the provider - guarantee - The Provider guarantees the Customer, in accordance with the legal provisions and without additional payment, against any lack of compliance or hidden defect, a result of a failure to design or carry out the Services ordered. In order to assert its rights, the Customer will have to provide as soon as possible all the factual elements that he can gather unless the non-compliance has been found on the spot by the Provider. Any complaint about the Customer's stay must be addressed in writing or by email to the Provider.
